Applicability Rules - File Version

Created a very basic 3rd party package 

Prerequisite Rule = X64

Applicability Rule =  NOT File Version: Path C:\Program Files\Common Files\........ \somefile.dll Common Path=NONE Comparison=EqualTo Version = latest version #

Installed Rule File Version: Path C:\Program Files\Common Files\........ \somefile.dll Common Path=NONE Comparison=EqualTo Version = latest version #

So my thought process is the package is applicable if the file is NOT equal to the latest version number specified, and it is installed once that file is up to the version specified.

Publish the package and checking machines in my test group and the status is stating that it is not applicable. Verified that the file I specified in the rules is 100% accurate and has a lesser version than I specify. I have also tried the Common Path option within the rule set and same result.

This file does not have a registry key associated to verify version from.
